Federal Judge Orders Freedom of Kilmar Abrego Garcia from Immigration Custody
A federal judge has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement is without legal authority.
"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," the judge wrote in her order.
The case originates in a mistaken removal to El Salvador earlier this year, which US authorities later acknowledged was an error. Following his repatriation to the United States to answer alien smuggling allegations, he was detained in federal custody.
In her decision, the judge pointed out that the authorities does not have a valid deportation order, which prevents them from removing Mr. Abrego Garcia "at this time."
Context of the Case
The court proceedings center on disputed claims. While the Trump administration argues that Abrego Garcia is a affiliate of the MS-13 gang, he categorically denies this claim.
He has also pleaded not guilty to the conspiracy charges, which are part of a separate trial in Tennessee.
Conditions of Freedom
The judge, who was hearing his challenge to deportation in a federal court, determined that he must now comply with the terms of his bond from jail in Tennessee. This decision shifts his monitoring to the jurisdiction handling his criminal case.
This ruling marks a significant development in a complicated legal battle featuring claims of wrongful detention and contested gang associations.
