The NBA legend Tells Court He ‘Wasn’t Afraid’ of the Racing Body in Antitrust Trial

Michael Jeffrey Jordan, as he cordially introduced himself in a Charlotte court on Friday, stated that his competitive side and status as a newcomer emboldened his effort with 23XI Racing to confront Nascar over perceived violations of competition laws.

Financial Stakes and a Competitive Drive

The owner disclosed operational insights of his racing venture, saying he invested $40 million of his own funds into the Nascar Cup series team co-founded with partner Polk and driver Hamlin.

“Someone had to step forward,” Jordan said during testimony. “As a newcomer, I wasn’t afraid. I believed I could take on Nascar as a whole. I felt as far as the sport it needed to be looked at from a different view.”

The Core Dispute: Charter Agreements and Contract Pressure

At issue is the end of a 2016 deal where Nascar granted each team a “charter”. The concept is similar to other major leagues with independent franchises, like the Charlotte Hornets or the Carolina Panthers. This deal was set to expire in 2024 when Nascar demanded charter membership renewals.

Jordan testified for an hour and exited the courthouse to a media frenzy, with fans and media clamoring for a view or a picture of the sports legend.

Spearheading the Fight

23XI Racing is at the forefront of the push along with Front Row Motorsports for Nascar to overhaul a operating model Jordan said is unlawful to keep two hands on the wheel.

“Denny convinced me getting a third driver boosted our odds of winning,” he testified, noting that he bought a third charter last year for $28m amid the legal dispute. “So I dove in.”

Heather Gibbs detailed her request for permanent charters, which she said a written letter to Nascar. She said the pressure of the contract signing demand didn’t sit well.

According to her, Joe Gibbs first tried to call and persuade Nascar against forcing signatures, but Nascar’s leader refused the appeal.

“Please don’t force this on us,” Heather Gibbs said was the message to Nascar’s leadership. She said France replied, “Whether I have 20 charters, I have 20. If there are 30, I have 30.”
