The former personal attorney for Donald Trump has resigned as New Jersey's top federal prosecutor. This follows a court battle that questioned her right to occupy the role.

Attorney General's Statement

The nation's top law enforcement official, Pam Bondi, accepted Habba's resignation on the start of the week. In a statement that the appeals court finding made it "untenable" for Habba to perform her duties.

"Let no one confuse following the order as giving up," she declared. "The effort will now stretch across the country."

Legal Background

Habba's exit follows closely on a federal appellate panel determined that she had been serving in violation of the law as the federal prosecutor. This judgment is expected to impact many prosecutions in New Jersey.

The court ruled that a interim role that skirted confirmation by the US Senate breached the statute on vacant positions.

Ongoing Legal Battle

It was also stated that she will remain at the Department of Justice as a senior adviser. She will pursue additional appeals of the ruling, in the hope of achieving a reversal.

On a social media platform, Bondi wrote that judges "should not be able to second-guess the appointment of lawyers tasked with performing the executive branch's core responsibility of enforcing the law."

Accomplishments Cited

The attorney general praised the prosecutor's work and noted that during her run, the city of Newark saw a 20% reduction in criminal activity. She also stated that the Camden had its first summer in 50 years free from homicides.

Legal Career

The 41-year-old attorney, originally became part of Trump's personal legal team in recent years. She later acted for Trump in his business records case in New York last year, leading to his conviction on multiple felony counts of document fraud.

Before Habba took on the federal prosecutor position, Trump had announced he was appointing her as his senior adviser in a potential future term, calling her as deeply loyal and a "tireless advocate for justice".
